Social security audit

Employers are confronted by the notification of a social insurance institution that they will be performing a social security audit at least every four years. You should prepare yourself well for the audit in order to ensure that audit proceeds as seamlessly as possible, particularly in view of the fact that the employer mainly bears the “risk of back payment”.

Here we are also happy to be active on your behalf in advance in preparing your payroll and salary accounting insofar as you do not perform the payroll accounting yourself as part of our wage check so that audits don’t have to be any matter of concern in the first place.

The pension insurance institutions inspect whether you fulfil your reporting obligations under social insurance law and your other statutory duties, which are in connection with the contributions paid for health, nursing, pension and unemployment insurance, in an orderly manner. They check in particular whether the legally required notifications have been issued, the payroll documents - including the required ongoing entries - are complete and the social security contributions have been calculated correctly and paid on time. Here all the employment and training relationships that existed during the audit period are audited. The audit of the payroll documents also includes the payroll documents of the employees for whom no social security contributions have been paid, e.g. persons employed for a short period of time.

The legislator has obligated the employer to provide appropriate “audit assistance”, i.e. to provide the necessary documents and answer the auditor’s questions.

We assume the task of answering the questions, preparing the documents and attend to the sequence of the audit ensuring you are burdened as little as possible and that the audit has an ideal outcome for you.

If it is not possible to reach an agreement during the final meeting then our lawyers will also assume the task of your legal representation, competently supported, and also well informed of the details of your case by the staff of our payroll accounting department, in order to assert your interests vis-à-vis the social insurance agencies.
